THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT THE RESPONDENT NOT TO INDULGE IN COERCIVE RECOVERY PROCEEDING DURING THE PENDENCY OF THE SUIT, AND ETC.
THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Sri.Vasanth Adithya, learned counsel for the petitioner.
Taking into account the order to be passed by this Court, it is not necessary to issue notice to the respondent.
2. The petition is admitted for hearing. With consent of the learned counsel for the parties, the same is heard finally.
3. In this petition, the petitioner inter alia seeks for a direction to consider the proposal submitted by the petitioner to restructure the loan.
4. After hearing the learned counsel for the parties and in view of the facts of the case, I deem it appropriate to dispose of the petition with a direction that suitable action, if not already taken on the proposal submitted by the petitioner, shall be taken in accordance with law by the competent authority by a speaking order within three weeks from the date of receipt of certified copy of the order passed today. It is made clear that this Court has not expressed any opinion on the merits.
Accordingly, the petition is disposed of.
