All these cases relate to the acquisition for the purpose Kerala State Transport Project namely widening of Kottarakara- Adoor-Chengannor M.C. road. L.A.A. 701/2011 is from the judgment in L.A.R. No. 377/2005. The land was acquired as per notification under section 4(1) dated 21.7.2003. The land value fixed by the Land Acquisition Officer is at the rate of `.23170/- per are which has been enhanced to `.1,50,000/- per are.
2. In L.A.A. 787/2012 the notification under Section 4(1) is dated 7.1.2003. The Land Acquisition Officer fixed the land value at the rate of `.23,172/- per are which has been enhanced to `,1,50,000/- per are.
3. In L.A.A. 599/2012, the notification under Section 4(1) was dated 7.1.2003 and the Land Acquisition Officer fixed the land value at the rate of `.19,175/- per are which has been enhanced to `.1,35,905/- per are.
L.A.A. Nos.701/2011 & conn.cases :2:
4. In these cases, the reference court has granted an enhancement based on the judgment in different land acquisition cases. As of now, the learned counsel for the respondent submitted that, in the light of the judgment of this court in L.A.A. 520/2012, wherein in respect of similar items of properties, this court has confirmed the land value fixed at the rate of `.1,60,000/- per are, nothing survives in these appeals. In L.A.A.520/2012, we have already confirmed the refixation of land value at `.1,60,000/- per are. The acquisition is under the same notification and the purpose is the same. Hence, the said judgment squarely applies here.
There is no scope for interference. Accordingly, we dismiss the appeals and confirm the judgments of the Reference Court involved in each of the appeals. No costs.
