Ramachandran Nair, J. This appeal is filed from the judgment in L.A.R.51/2004 on the file of the Sub Court, Thiruvananthapuram. We find from the judgment of the reference court that L.A.R. No.51/2004 was tried along with L.A.R. No.61/2004 and a common judgment has been rendered. The State had filed L.A.A. NO.445/2012 against the judgment in L.A.R. No.61/2004 and the same was dismissed by judgment dated 26.7.2012. Therein, reliance was placed on the judgment of this Court in LAA No.1127/2009 and the Bench took the view that the issue raised by the Government in the said appeal is already covered against the appellants.
In the light of the above, we dismiss this appeal. No costs.
