(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) In view of the same judgment impugned herein having been carried in appeal in LPA No.1753 of 2011 and another Division Bench having already clarified the issue of liability of respective parties while disposing of that appeal on 16.01.2012, the present appeal does not survive for any order on merits. Therefore, it is not required to be entertained and accordingly disposed alongwith the civil application.
