(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant - convict has prayed that he be released on temporary bail to attend the marriage in the family of his daughter.
Pursuant to the earlier order passed by this Court, learned APP Mr.Pandya, on verification, has submitted that the ground mentioned in the application is genuine.
From the jail remarks, we find that on earlier occasion the applicant-convict was released on temporary bail and on furlough, he has surrendered in time before the jail authority.
Considering the totality of the facts, the applicant - convict is ordered to be released on temporary bail for a period of 10 days from the date of his actual release on personal bond of Rs.5,000/- and one surety of like amount with the further direction that on expiry of period granted by this Court, the applicant - convict shall surrender before the Jail Authority in time.
The application is allowed to the aforesaid extent. Rule is made absolute.
