(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present appeal arise against the judgment and the order dated 23.12.2009 passed by the learned Special Judge in Special Case No.6 of 2000, whereby, the accused has been acquitted for the offence under Sections 7, 13(1)(d) and 13(2) of the Prevention of Corruption Act.
The report has been received by the office from the office of the Government Pleader that the accused, Kumarkant Chhabildas Shah (Jain), Vaniya, has expired on 3.10.2011 and the death certificate has also been produced.
Under the circumstances, the appeal would not survive and shall stand abated. Disposed of accordingly.
