JUDGMENT / ORDER

1. The facts in this petition are disturbing, as it appears on the record that the witness who is yet to be examined by the Investigation Officer is not traceable, in spite of the fact that he is getting pension. The approach by the Presiding Officer as well as APP seems to be casual, which has led the passage of all these years keeping the trial pending.
2. Therefore, Notice is ordered to be issued to the respondent returnable on 25.06.2012. Learned APP Ms. Raval shall see to it that Direct Service is taken and it is served. Learned APP Ms.Raval shall also call for details of witness Mr. N. J. Parmar, who is sought to be examined including his last address recorded in the pension papers.
