(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application is preferred for leave to prefer appeal against the judgment and order passed by the learned Sessions Judge in Sessions Case No.384 of 2009; whereby, respondent No.1 has been acquitted.

The conviction appeal has been preferred by the other original accused in Criminal Appeal No.1096 of 2011, which has already been admitted.

Considering the facts and circumstance, leave deserves to be granted. Therefore, granted. Application disposed of accordingly.
