(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application is for condonation of delay of 20 days in preferring the appeal against the judgment and order passed by learned Sessions Judge in Sessions Case No.79 of 2009.
Respondents are served. Mr.Parikh, learned advocate appears for respondent No.5, Mr.Manan Mehta learned advocate for respondent No.4 and Mr.Mangukiya, learned advocate for respondent Nos. 1 to 3. Other respondents are served but non appears.
Considering the facts and circumstances and in view of the grounds stated in the application for condonation of delay, sufficient cause is made out. Hence, delay deserves to be condoned. Therefore, condoned.
Application is allowed to the aforesaid extent. Rule made absolute.
