JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) Affidavit-in-reply filed on behalf of the State Government was for the purpose of opposing the stay application and the State Government has not filed any reply to the amended petition. Mr.Mitul Shelat, learned counsel for the petitioner states that though he has taken a point with regard to NCTE Act in paragraph 3.8 of the writ petition, he wants to elaborate the point by filing an amendment. His prayer is accepted and 24 hours time to file amendment is granted. Thereafter, learned Government Pleader is allowed two days time for filing detailed affidavit-in-reply to the amended writ petition as well as to the proposed amendment. In the affidavit-in-reply, learned Government Pleader shall clearly explain as to whether any Rules have been framed by the State Government under the NCTE Act, 1993 or any amendment has been made after the Right of Children to Free and Compulsory Education Act, 2009 was enforced or any Act or Rules have been made in pursuance of the judgment of the Apex Court in State of Maharashtra v. Sant Dhyaneshwar Shikshan Shastra Mahavidyalaya and Others [(2006) 9 SCC 1].
