1. It appears that the matter is being adjourned time and again on the ground that the Record and Proceedings from the learned trial Court is not received. It appears from the office note as well as the report from the concerned Court that the Record and Proceedings of the case is missing from the learned trial Court. The learned Principal District and Sessions Judge, Surat is directed to hold inquiry with respect to missing of the Record and Proceedings of the case and submit the report before this Court within a period of three weeks from today.
2. This Court also tried through the concerned Public Prosecutor that the Record and Proceedings from the Legal Department or from the office of the concerned DGP is received so that the Record and Proceedings can be ordered to be reconstructed, however, Shri L.B. Dabhi, learned APP appearing on behalf of the State has stated that despite the communication to the Legal Department as well as the concerned DGP with respect to sending the papers there is no response from them. Under the circumstances, stand over to 23/10/2012. Let the responsible Officer from the office of the Legal Department as well as the concerned DGP remain present alongwith the record of the concerned case so that on that day appropriate order for reconstruction of the order can be passed. The copy of this order be given to the learned APP.
