Ms.Hansa Punani, learned APP submits that respondent - original accused has expired on 16.6.2010. In support of her statement she has produced death certificate of original accused on record. The said statement is confirmed by Mr.Vijay Nagesh, learned advocate for the opponent.

Accordingly, the Criminal Appeal is abated.

In view of disposal of Criminal Appeal the Criminal Misc. Application No.6086 of 2012 do not survive. Hence it is disposed of.
