The factual averments made by the petitioner in the application are found, on enquiry by the police, to be absolutely incorrect insofar as the petitioner's mother is reported to be taken care of by the brother of the petitioner, and the averments regarding poor financial condition is also found to be doubtful insofar as his family is holding sufficient land to sustain the family. Therefore, the petition is dismissed and Rule is discharged.
