State vs Ms Monali Bhatt

High Court Of Gujarat|13 February, 2012

JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA)
1. After arguing at some length and listing of the appeals for no less than 64 times, it was submitted by learned Senior Advocate, Mr.Sanjanwala, on instructions of the appellants, that since the advocate for the appellants could not remain present before learned Single Judge when the original petitions were heard and disposed and since many questions of fact were involved which were required to be put before learned Single Judge, the appellants propose to approach learned Single Judge by way of review applications. It was on that basis requested that the appeals may be permitted to be withdrawn in the interest of justice. Learned counsel for the respondents having no objection, appeals as well as the applications made therein are disposed as withdrawn without entering into merits, if any, of the contentions of the parties.
2. It is needless to observe, but observed at the instance of learned Senior Counsel, Mr.Sanjanwala, that if and when review applications are made by the appellants they may be heard and disposed in accordance with law, if delay in filing such applications is condoned, without being influenced by withdrawal of these appeals.
