(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) It is stated by learned APP that the appeal against the conviction and sentence has been preferred by both the accused being Criminal Appeal No.133 of 2012. Since the paper book of this criminal confirmation case is already available, no Paper book would be required in the appeal preferred by the convict.
As per proviso of Section 368 of Criminal Procedure Code, no order for confirmation can be passed until the appeals are disposed of. Hence, appeal as well as the present confirmation case be listed for final hearing in the reopening after summer vacation in a week beginning on 18th June, 2012.
