Delay of 212 days in preferring the application for joining the heirs is required to be condoned in the peculiar facts of the case and in the interest of justice, so as to have proper hearing on merits of the Letters Patent Appeal which has been pending since the year 2004. Accordingly, the application is allowed and Rule is made absolute with no order as to costs. Civil Application (Stamp) No.10830 of 2011 be listed for hearing on 24.4.2012.
