The present applications have been filed for the stay of the implementation, operation and execution of the judgment and award dated 10.01.2005 passed by the learned 2nd Extra Assistant Judge & Special Judge (L.A.R.), Ahmedabad (Rural) at Ahmedabad in L.A.R. Nos.677 to 692 of 1998 on the grounds stated in the applications.
It is required to be mentioned that the award has been assailed by way of aforesaid First Appeals, which have already been admitted vide order dated 24.09.2007.
Having heard learned AGP Mr.P.P. Banaji for the applicants and learned counsel, Mr.Bharat Prjapati for the original claimants and having considered the rival submissions, the interest of justice would be served if the interim relief in terms of Para No.6(B) is granted on a condition that 33% of the awarded amount is deposited before this Court within a period of four weeks, which shall be permitted to be withdrawn by the claimants by filing appropriate application for withdrawal on usual terms and conditions.
With the above observations and directions, the present applications stand allowed. Rule is made absolute.
