(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) By way of this application, the applicant - convict has prayed that he be released on temporary bail on the ground that he wants to participate in religious ceremony which is started from 24.04.2012.
Pursuant to the earlier order passed by this Court, learned APP Mr.Pandya, based on the instruction received by him from Gadhsisha Police, has submitted that the ground mentioned in the application is genuine.
From the jail remarks, we find that the applicant has not been released since November 2011 and on earlier whenever the applicant-convict was released on temporary bail or on furlough, he has surrendered in time before the jail authority.
Considering the totality of the facts, the applicant - convict is ordered to be released on temporary bail for a period of one week from the date of his actual release on his furnishing personal bond of Rs.5,000/- of like amount with further direction that on expiry of period granted by this Court, the applicant - convict shall surrender before the Jail Authority in time.
The application is allowed to the aforesaid extent. Rule is made absolute. Direct service is permitted, today.
