(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant - convict, through his wife, has prayed that he be enlarged on temporary bail to construct the house which is demolished by the Local Authority.
Pursuant to the earlier order passed by this Court, learned APP, Mr.Pandya, based on the report which he has received from Kapodara Police Station, has submitted that the demolition has taken place on 27th March 2012 by the Local Authority.
From jail remarks, we find that the applicant was already released on furlough from 30th March 2012 to 12th April 2012.
Under the circumstances, we are not inclined to exercise the discretion. Hence, application is rejected. Rule is discharged.
