1. The present second appeal has been placed on the board at the request of learned Assistant Government Pleader appearing on behalf of the appellants for withdrawal of the main second appeal.
2. Mr.Pranav Dave, learned Assistant Government Pleader appearing on behalf of the appellants has placed on record communication dated 31/05/2011 from the Section Officer of the Home Department addressed to the Government Pleader permitting a State to withdraw the Second Appeal as original plaintiff has expired. Communication dated 31/05/2011 is directed to be taken on record.
3. In view of the above and without prejudice to the rights and contentions of the State in the other Second Appeals arising out judgement and order dated 17/10/2000 passed by learned District Judge, Junagadh in Regular Civil Appeal Nos.108/1990, 109/1990 and 110/1990 and as the original plaintiff has expired, the present second appeal is dismissed as withdrawn. No costs.
