(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application is for condonation of delay of 83 days in preferring appeal against the judgment and the order passed by the learned Sessions Judge in Sessions Case No.46/2009.
Heard Mr.Pandya, learned Additional Public Prosecutor for State and Mr.Oza, learned advocate for respondent Nos.1 to 4.
Considering the facts and circumstances and in view of the grounds stated in the application for condonation of delay, sufficient cause is made out. Hence, delay deserves to be condoned and therefore, condoned.
Application allowed to the aforesaid extent. Rule made absolute accordingly.
