1. It is not in dispute that the subject matter for which an appeal is filed under Rule 108(6) of the Revenue Rules, 1972 before the District Collector, Jamnagar and on 09.02.2012, while said appeal was under consideration, the District Collector has passed an order of status-quo.
2. In above circumstances, to provide protection to the petitioner or to pass any other order with regard to the possession of the disputed land for which proceedings are already pending before the District Collector would amount to creating the right either in favour of the petitioner or disputant.
In view of above circumstances, this petition is rejected.
