State vs Mr Jk Shah App For

High Court Of Gujarat|19 April, 2012

JUDGMENT / ORDER

1. This petition under Articles 226 and 227 of the Constitution of India is a gross abuse of process of law by seeking a prayer to direct investigation on the basis of the xerox copy of the stamp paper annexed at Annexure - A to the petition and submissions are made that in absence of the name of the vendor, stamp paper etc., the above stamp paper appears to be bogus and, therefore, powers be exercised.
2. The very basis of the petition is misconceived inasmuch as just because xerox copy of the stamp-paper bears no name of the vendor or other particular, powers under Section 226 and 227 of the Constitution of India cannot be exercised as prayed for and in absence of merits, this petition is summarily rejected.
