(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application is for condonation of delay of 78 days in preferring appeal against the judgment and order passed by the learned Sessions Judge in Sessions Case No.306/09.
The respondent was served and on her behalf, it appears that her husband had taken time to engage advocate. Today nobody is present on behalf of the respondent.
Considering the facts and circumstances and in view of the grounds stated in the application for condonation of delay, sufficient cause is made out. Hence the delay deserves to be condonedand therefore condoned.
Application allowed to the aforesaid extent. Rule made absolute accordingly.
