Shri Hardik Soni, learned AGP submitted that the amount as recored in the order dated 22.02.2012 is paid. The receipt is placed on record. He further submits that now there is a complete compliance with the order.
Unfortunately, Shri Mankad, learned advocate for the opponent is not present. However, copy of receipt is placed on record, which indicates that the amount of Rs.38,475/- is received by the lady, opponent in this Civil Application.
In view of this, Civil Application is required to be allowed and is accordingly allowed on condition that in case, if this submission is found to be incorrect appropriate action will be taken including dismissing of this petition. The main matter i.e. S.C.A. No.16635 of 2011 is restored to its original record.
(S.R.BRAHMBHATT, J.) pankaj After this order was passed and before it was signed Shri Mankad appeared and submitted that there cannot be any objection of restoring of the main matter. But it was brought to the notice of the Court that the wages mentioned hereinabove which covering the period of January, February and March which are outstanding will have to be paid, therefore, appropriate direction be issued.
In light of this submission, it goes without saying that the arrears, if any, is to be cleared at the same rates and hereafter till the disposal of the main matter. The respondent shall keep continuing paying the wages at the same rate at which the arrears are paid.
