(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application has been preferred by the applicant-convict for leave to prefer an appeal against the judgment and the order passed by the learned Sessions Judge in Sessions Case No.257 of 2010; whereby, the accused Nos.1 and 2 have been acquitted for the offence punishable under Sections 363, 366 and 376 of IPC. It appears that the conviction appeal has already been preferred by the other co-accused being Criminal Appeal No.930 of 2011, which has been admitted.
Considering the facts and circumstances, leave deserves to be granted. Therefore, granted. Application disposed of accordingly.
