1. The present application is preferred for leave to prefer appeal against the judgment and order passed by the learned Sessions Judge in Sessions Case No. 40/2010, whereby, the learned Sessions Judge has acquitted the original accused no. 1,3,4 and 5 for the charged offences.
2. Mr.
P.M. Lakhani learned counsel appearing for the accused states that original accused no. 2 who has been convicted has preferred Criminal Appeal No. 682/2011 and the said appeal has been admitted on 21.6.2011.
3. Considering the facts and circumstances,leave deserves to be granted, and therefore, granted. Application stand disposed of accordingly.
