This application under Section 439(2) of the Code of Criminal Procedure, 1973 is preferred by the State of Gujarat seeking with a prayer to quash and set aside the order dated 15th December 2011 passed by learned Additional Sessions Judge, Jamnagar, granted anticipatory bail to the accused for the offences under Sections 406, 420, 467, 468 and 114 of the Indian Penal Code vide registration of C.R. No. 457 of 2011 at Jamnagar City 'B' Division Police Station by imposing suitable conditions within parameters of Section 438 of the Code and law laid down by the Apex Court in Siddharam Satlingappa Mhetre v. State of Maharashtra & Ors. [(2011)1 SCC 694], which do not require any interference particularly keeping in mind the nature of transaction that have taken between the parties.
The application is rejected. Notice discharged.
