(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed seeking condonation of delay of 23 days. Rule was issued on 7th May 2012 returnable today, viz. 25th June 2012.
On perusal of papers it is learnt that the rule issued by this Court was served upon respondents no.1 to 5 on 25th May 2012. In view of the fact that though rule issued by this Court was served nobody appears for the respondents, this application is allowed. Delay is condoned. Rule is made absolute.
2. At the request of the learned APP, Mr.L.R. Pujari, the Criminal Appeal and the application seeking leave to appeal are ordered to be listed on 9th July 2012.
