(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application is for condonation of delay of 18 days in preferring appeal against the judgment and order passed by the learned Sessions Judge in Sessions Case No.275/96.
Mr.Pandya, learned APP has placed on record the report of the PSI, Sabarmati Railway Police Station, intimating that the respondent has been served on 23.03.2012. The said report is taken on record.
Heard Mr. Pandya, learned APP for the State. None appears on behalf of the respondent.
Considering the facts and circumstances and in view of the ground stated in the application for condonation of delay, sufficient cause is made out. Hence, delay deserves to be condoned and therefore, condoned.
The application is allowed to the aforesaid extent. Rule made absolute accordingly.
