1. We have heard learned AGP Mr.N.J.Shah for the applicants and learned counsel Mr.Navin Pahwa for the private respondents.
2. Learned counsel Mr.Navin Pahwa has pointed out that since the term of the elected committee has been expired and new election has taken place and new committee has already taken the charge. The common judgment of the learned Single Judge has given rise to filing of Civil Application No.9857 of 2011. He further states that this Court has also dismissed one Letters Patent Appeal No.226 of 2012 and therefore this application has become infructuous.
3. This application has been filed for condonation of delay of 643 days in filing the appeal. We do not find any sufficient justification of the grounds taken to condone the delay in filing the appeal and, therefore, this application is rejected.
4. Consequently, Letters Patent Appeal (Stamp No.) 1246 of 2011 and Civil Application (Stamp No.) 8933 of 2011 stands also dismissed.
