JUDGMENT / ORDER

RULE.
To be heard along with Special Civil Application No. 18129/2011.
There shall be ad-interim stay of the impugned award qua the direction regarding grant of continuity of service and back wages on condition that the petitioner will reinstate the respondent workman within a period of thirty days from today. If the workman is not granted reinstatement within the above period, then the respondent workman shall be at liberty to initiate proceedings under Section 33(c)(2) of the Industrial Disputes Act claiming for back wages as if he was in continuous service.
