(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) The appeal is preferred from the interim order of learned Single Judge of this Court in pending Special Civil Application no. 4238 of 2011. By the impugned order dated 27/12/2011, it is clearly stipulated that the interim order is subject to further order that may be passed by that Court, even as further hearing of the matter was fixed on 8/2/2012. Therefore, it was for the appellant to pray for further order or modification of the impugned order, if so advised. Otherwise, the matter can as well be heard for final disposal by learned Single Judge at the request of the appellant. Therefore, the appeal is not entertained and summarily dismissed along with civil application.
