(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The Board shows that one Mr.D.N. Vora appears for respondents no.1 to 8. So far as respondent no.9 is concerned it is mentioned that the appeal stands abated. So far as respondents no.10, 11 and 12 are concerned they are shown to have been served.
Learned Additional Public Prosecutor drew the attention of the Court to the fact that respondents no.2 and 8 have also expired. In support of his submission, the learned APP places on record a xerox copy of communication dated 8th February 2012 received from the Police Sub Inspector, Gondal Taluka Police Station, District Rajkot (Rural), intimating the aforesaid fact. That being so, the appeal stands abated qua respondents no.2 and 8 also. So far as as learned advocate Mr.D.N. Vora is concerned, he has filed Vakalatnama on a printed Vakalatnama of Khanderia Advocates, Opposite Havai Bungalow, Gondal, whereas learned advocate Mr.D.N. Vora has affixed his rubber stamp, wherein his only address given is "Near Court-Gondal". So far as respondents no.10, 11 and 12 are concerned they are though served 'nobody' appears for them.
2. In light of the aforesaid facts, it is deemed proper that the Registry be directed to issue NOTICE to all the surviving respondents returnable on 27th February 2012 and the learned Additional Public Prosecutor shall see to it that the same is served to the respondents. Direct service is permitted.
