(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) This Court issued fresh notice on 28th February 2012 to the respondents returnable today, viz. 12th March 2012. The notice is served and in response to that notice, Bhuljibhai Chhotubhai Gamit, respondent no.1 herein is before this Court. He is accompanied by his son, who tells that Bhuljibhai Chhotubhai Gamit is doing agricultural labour work. Son of Bhuljibhai Chhotubhai Gamit states that he (son) has studied upto Standard-IX. He further states that Majibhai Chhotubhai Gamit is his uncle, who is in fishing activity. Said uncle is employed on a fishing boat and he goes on fishing activity for 5-6 months at a stretch, states son of Bhuljibhai Chhotubhai Gamit. Xerox copy of the above statement is taken on record.
At this juncture, learned Additional Pubilc Prosecutor, Mr.Pujari places on record for perusal statement of son of respondent no.2-Majibhai Chhotubhai Gamit (sic., Manjibhai Chhotubhai Gamit), namely, Jitendrabhai Alias Jitubhai. It is stated that his father has gone to Mumbai for fishing after Diwali and thereafter he has not returned home and is likely to return only on onset of monsoon and that will be somewhere in the later part of June 2012. It is further stated in the statement by son of Manjibhai that Manjibhai's address and telephone number are not known to the family members. It is further stated in the statement that as and when his father returns home he will inform his father about the case pending before the Court.
2. Bhuljibhai Chhotubhai Gamit, through his son, prays for services of an advocate from Legal Aid. The request is granted. The matter is adjourned to 2nd July 2012. In the meantime, the Registry is directed to arrange for an advocate from legal aid for respondent no.1.
