It appears from the office note that the office has received a letter from Mrs. Shrimali Sushilaben Manharbhai that her husband Manharbhai Bechardas Shrimali was serving in Police Department and a case was filed against her husband Manharbhai but was acquitted by the trial Court and the present appeal has been preferred by the State against acquittal. It is also stated that said Manharbhai has expired on 11.11.2011. Therefore the matter is placed for appropriate orders. A certified copy of Death Certificate issued by Ahmedabad Municipal Corporation is attached with the letter written by Mrs. Shrimali Sushilaben Manharbhai.
Learned A.P.P. Ms. C.M. Shah for the State states that in view of the death of respondent No. 1 Manharbhai, necessary orders may be passed.
Having regard to the office note, letter of Mrs. Shrimali Sushilaben Manharbhai and certified copy of Death Certificate, it appears that respondent No. 1 Manharbhai has expired on 11.11.2011. Therefore, the appeal qua respondent No. 1 Manharbhai Bechardas Shrimali stands abated.
