State vs Aiyazkhan

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application is for leave to prefer appeal against the judgement and order passed by the learned Special Judge in Sessions (NDPS) Case No.153 of 2005, whereby the accused have been acquitted for the offence punishable under Sections 8(C), 20(2) and 29 of NDPS Act read with Section 419 of IPC.

Considering the facts and circumstances, leave deserves to be granted and, therefore, granted. Application is disposed of accordingly.
