JUDGMENT / ORDER

Heard Sri A.K. Bhatnagar, learned counsel for the appellants-State and perused the record. Pt. S. Chandra, learned counsel for the respondent is reported to be out of station. The matter involved in this appeal relates to the year 2000 and the special appeal was filed in the year 2001. This appeal has been filed against the interim order dated 13.10.2000, passed by the learned Single Judge in W.P. No. 5567 (S/S) of 2000, after delay of more than eight months.
We are not inclined to entertain the special appeal preferred against the interim order dated 13.10.2000, which was passed after hearing the State counsel and was in the knowledge of the State Government, after delay of more than eight months and, therefore, no interference is needed in the instant appeal after nine years of the aforesaid interim order. Till date no stay order has been passed in this appeal against the interim order of the learned Single Judge nor even the delay has been condoned.
Under the facts, we do not find any ground to entertain the appeal and condone the delay.
The special appeal is dismissed.
Learned counsel for the State-appellants says that he is not aware whether the writ petition has been disposed of or not? In case the aforesaid writ petition is pending, the same may be listed before the Bench concerned, at an early date, say within next two months, for hearing.
