1. Learned A.G.A. for revisionist.
2. This Criminal Revision has been filed on behalf of State of U.P. against judgment and order dated 24.06.1991 passed by Vth Additional Chief Judicial Magistrate, Agra in Case No. 181 of 1991 whereby the Trial Court discharged respondent-Surendra Pandey in spite of sufficient evidence against him. The Trial Court has given benefit of Section 4 of Probation of Offenders Act, 1958 (hereinafter referred to as "Act, 1958") to accused.
3. However, despite repeated query, learned A.G.A. appearing for revisionist could not point the findings recorded by Court below are perverse or contrary to material on record. I, therefore, do not find any manifest error illegality, procedural or otherwise, so as to justify interference in criminal revision.
4. Dismissed. Interim order, if any, stands vacated.
5. Certify this judgment to the lower Court immediately.
