Heard learned counsel for the parties.
This First Appeal has been preferred by the appellants against the judgment and decree dated 7.4.1998 passed by learned District Judge, Maharajganj in L.A.R. no. 15 of 1994.
Learned counsel for the appellants has vehemently argued various points in support of his contention and has submitted that judgment and order passed by the court below is illegal, perverse and against the law and the same cannot be sustained in law as the relevant material has not been considered by the Court below.
The matter involved in this appeal has already been discussed and detailed judgment has been passed by the High Court of Uttranchal by a Division Bench in the case of Bhupendra Singh and others Vs. Awas Vikas Parishad and another reported in 2005 (2) U.D. 295.
We have examined the judgment and order passed by the court below in depth and we have carefully perused the findings recorded by the court below, we are in full agreement with the same.
Learned counsel for the appellants has failed to establish any illegality or infirmity in the judgment and order of the court below.
The First Appeal is devoid of merits and is hereby dismissed.
