This application under section 5 of Indian Limitation Act has been filed with a prayer to condone the delay in filing the appeal against the judgment and order dated 24.08.2006 passed by learned Additional Sessions Judge/ Fast Tact Court No. 3 Ballia in S.T. No. 280/04 and connected with S.T. No. 281/04. whereby the accused respondents have been acquitted for the offence punishable under section 302/34 I.P.C. This appeal has been filed beyond the period of Limitation by 4 days. Sufficient cause has been shown to condone the delay in filing the appeal, therefore, the delay in filing the appeal is hereby condoned. Office is directed to allot the regular number to this appeal. Accordingly this appeal is allowed.
