JUDGMENT / ORDER

Heard learned counsel for the applicant, learned AGA and perused the record.
The present application for cancellation of the bail dated 1.11.2007 has been filed by learned AGA on behalf of State in Case Crime No. 233 of 2007, under Section 498-A, 323, 307, 315, 504, 506 I.P.C. and Section 3/4 of Dowry Prohibition Act, P.S. Kotwali Dehat, District Shahranpur.
The allegation is that the husband of the victim accused opposite party no. 2 was trying to pressurize the victim to withdrawal the case. The bail application was allowed by learned Session Judge, Saharanpur on 8.7.2007 in the aforesaid case. Counter affidavit was served and filed on 16.11.2009. However, no rejoinder affidavit has been filed.
Counsel for the opposite party submitted that the matter has been settled in between the parties and lump sum amount of Rs. 3, 50,000/- was paid to the victim wife by the applicant in compliance of the settlement which took place before Mediator at Mediation and Conciliation Center, High Court, Allahabad.
He further contended that earlier the application for cancellation of bail no. 14286 of 2007, was rejected on 27.8.2009. Again the application has been filed.
Since the matter has already been settled in between the parties hence, no good ground for cancellation of the bail.
Accordingly, the present application is hereby rejected.
