The appeal has been filed beyond by 30 days along with delay condonation application. On 7.2.2011, notice was issued. On 11.1.2012 reported that no counter affidavit has been filed.
Sri Ashok Kumar Singh, Advocate has put in appearance on behalf of the respondent. On 12.1.2012, learned counsel for the respondent has sent illness-slip. Today again, an adjournment has been sought on the ground of illness.
Learned Standing Counsel submitted that the execution proceeding is going on to recover the entire decreetal amount from the District Election Officer. The copy of the order dated 16.3.2012 passed in execution case no. 2 of 2011 is Annexure-1 to the application.
In view of the above, let the case be listed in the next cause list i.e. on 23.4.2012 peremptorily. On the peculiar facts and circumstances of the case, till the next date, the execution proceeding shall remain stayed.
