After the matter was argued at some length, Sri Amit Sthalekar, Advocate on behalf of writ petitioners who are impleaded respondent Nos. 1 to 6 in this Appeal has stated that he has instruction to get the interim stay application filed in writ petition No.34105 of 2010 dismissed as not pressed and therefore, the order passed by the learned Single Judge may also be set aside without entering into the merits of the same.
On the stand so taken by the counsel for the writ petitioners, Sri Satish Chaturvedi, Additional Advocate General submits that in an earlier petition, this Court has directed that appellant must complete the process of selection after advertisement and therefore, directions be issued for the process being completed and brought to its logical end.
In view of the aforesaid, the stay application filed along with writ petition No.34105 of 2010 stands rejected as withdrawn. consequently, the order of the learned Single Judge dated 9/6/2010 stands set aside. It is further directed that the appellant may complete the process of selection and may offer appointment to the selected candidates. However, the appointments so made shall be subject to the final orders to be passed in the writ petition. Appellants are further directed to file counter affidavit in reply to the contents of the writ petition by 21st July, 2010.
Let the writ petition No.34105 of 2010 be listed before appropriate Bench on 21st July, 2010.
Subject to the directions issued, the present Special Appeal stands disposed of.
