JUDGMENT / ORDER

Sri Pankaj Patel, learned counsel appearing for the petitioner State contends that on one side the respondent no.1 is actively pursuing the execution proceedings but on the other side the proceedings in this Court are being delayed.
It has been pointed out that initially an order of stay of execution was passed by assigning reasons which subsequently was vacated.
I have taken note of the fact that written request for adjournment on the ground of illness has been filed by the learned counsel for respondent no.1. No one has put in appearance on behalf of respondent today in Court.
Considering the circumstance pointed out by Sri Patel, learned counsel for petitioner State, execution proceedings shall remain stayed.
