The State is aggrieved by the judgment and order of the State Public Service Tribunal, Lucknow dated 9.3.2009, directing the claimants to be promoted on the post of Executive Officer Class- III, Class-II and Class-I in Municipal Board with effect from the dates of promotion of Sri Bans Raj Singh within a period of three months.
Learned Standing Counsel states that the final seniority list was quashed. Subsequently, a provisional seniority list was prepared and that same has been stayed by the High Court at Allahabad in Writ Petition No. 3339 of 2009. The interim order is still operative.
It is further stated that Shri Bans Raj Singh was appointed as Executive Officer Class -IV in the Municipal Board in the year 1979 and that under the orders of the Tribunal in Claim Petition No. 2486 of 1994 dated 8.2.1996, he was given promotion. He would in any case be senior to the petitioner, who was appointed on adhoc basis in the year 1977 and was regularized on 3.6.1986. A writ petition against the judgment of the Tribunal in the case of Bans Raj Singh being No. 36548 of 1995 is pending.
The matter requires consideration.
Issue notice to respondent no. 1. Steps within a week. List after six weeks.
Until further orders the effect and operation of the judgment and order of the State Public Service Tribunal, Lucknow dated 9.3.2009 shall remain stayed.
