JUDGMENT / ORDER

This appeal is barred by limitation from 80 days. An application is preferred as per provisions of Section 5 of the Limitation Act to have condonation of the same. The application is supported by an affidavit sworn in by Shri Hafizur Rahman, Addl. Superintendent of Police, UP.RPB, Lucknow. Ignoring the delay, we have considered the special appeal on merits.
The respondent-petitioner, a person appointed on compassionate ground fails to qualify the criteria that is of covering a distance of 4.8 kilometers in 30 minutes. The default was by .01 minute.
Learned Single Judge invoking the equity jurisdiction directed the respondents to allow one more opportunity to respondent-petitioner with a clear direction that the same shall not be treated as a precedent. The order being based on equity, we are not inclined to interfere with the same.
For the reason given above, the appeal is dismissed.
