1. Heard Sri S.K. Khare, learned Standing Counsel for the State and Sri Sudeep Kumar, learned counsel for opposite party no.1.
2. Sri S.K. Khare, learned Standing Counsel has submitted before this Court a calculation-sheet prepared by the Committee of chief engineer and two executive engineers which shows an amount of Rs.1,21,91,412.00 as further due to be paid to the opposite party no.1. The same is prepared as per directions of the Court below. He fairly concedes that the said amount of Rs.1,21,91,412/- comes when the amount is calculated as per the judgment in case of Gurpreet Singh Vs. Union of India reported in (2006) 8 SCC 457.
3. Sri Sudeep Kumar, learned counsel for opposite party no.1 agrees that if the aforesaid amount is paid to the opposite party no.1, he shall forego all other claims, if any, against the revisionist with regard to award in question.
4. Learned Standing Counsel submits that the aforesaid amount is already deposited in Court under the directions of this Court.
5. In view thereof, since both the parties agree that the matter is covered by the judgment of Gurpreet Singh (Supra) and the calculation is also not been disputed, the present civil revision is disposed of with the direction that the aforesaid amount of Rs.1,21,91,412/- already deposited by the State with the High Court be released in favour of opposite party no.1 within a period of 15 days from the date a certified copy of this order is filed. Thereafter, opposite party no.1 shall not have any further claim against the revisionist with regard to award in question.
6. With the aforesaid, present civil revision is finally disposed of.
