JUDGMENT / ORDER

C.M. Delay Condonation Application No.20483 of 2010 This application has been filed for condoning the delay in filing the appeal. According to the Stamp Reporter, the appeal is barred by limitation by 104 days.
Various reasons, which prevented the appellants from filing the appeal within time, have been enumerated in the affidavit filed in support of the delay condonation application.
We are satisfied that the cause shown is sufficient for condoning the delay in filing the appeal.
Accordingly, the delay in filing the appeal is condoned. The application stands allowed.
Order on Appeal:
List has been revised.
Nobody appears on behalf of the respondent, although name of Sri Vijay Gautam has been shown as his counsel in the cause list. Admit.
While pressing for interim relief, Mr. Ghanshyam Dwivedi, learned Standing Counsel appearing on behalf of the appellants, submits that the finding recorded by the authority that the writ petitioner-respondent is not dependent of freedom fighter ought not to have been interfered with only on the ground that the certificate purportedly bore the signature of the District Magistrate. During the pendency of the appeal, operation of the impugned order dated 07.09.2009 passed by the learned Single Judge, shall remain stayed. Order Date :- 27.1.2010 RKK/-
