This appeal has been filed by the State/appellant with a prayer to grant leave to appeal against the judgment and order of dated 23.05.2001 passed by learned Special Judge (Gangster Act), Meerut whereby the respondents/ accused Wali and Ahsan were acquitted in Sessions Trial/ Special Case No. 81/1996 (State Vs. Wali and another) for the offence punishable under Section 2/3 of Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986, P.S. Baghpat, District Baghpat.
Learned trial has acquitted the respondents Wali and Ahsan for the offence punishable under Section 2/3 of Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986 on the ground that they have been acquitted in the cases on the basis of which gangster act was imposed against them.
Accordingly, I find no infirmity in the impugned order passed by the trial court.
In view of above, this application seeking leave to appeal is, accordingly rejected and consequently the appeal is also dismissed.
